Florida Workers' Compensation

Under Florida law, temporary total disability benefits are paid at what percentage of the employee's average weekly wage, subject to the statutory maximum?

Answer

66 2/3 percent

Fla. Stat. §440.15(2)(a): 'in case of disability total in character but temporary in quality, 66 2/3 or 66.67 percent of the average weekly wages shall be paid to the employee during the continuance thereof.' A higher 80 percent rate applies for up to 6 months only for certain catastrophic injuries, such as loss of a limb or paraplegia ((2)(b)), and weekly compensation may not exceed 100 percent of the statewide average weekly wage (§440.12(2)).
